​The popularity of Bluetooth has extended to locks on our front doors, but are they as safe as they sound?  With many consumers, especially the Millennials, love for new gadgets the cell phones have become an integral part of our daily routines.  From adjusting the climate control, turning the lights on or off to locking and unlocking the doors, today’s homeowners could adjust many functions in their homes remotely from anywhere in the world through their mobile devices.  This convenience at times has resulted in the expense of the safety, leaving the properties vulnerable to hack by many hackers.

In a recent hackers convention, Def Con, two researchers from Merculite Security put 16 smart locks to test to try to hack and open them.  Apparently, the weak link is in the Bluetooth transmission of commands and passwords from homeowners to the locks.  Some of the transmissions were in text instead of encryption while passwords were easily stolen through Bluetooth sniffers on others.  The locks communicating through simple texts with the App are proven to be the most vulnerable.  The example of these locks are:

​Florida Supreme Court’s latest ruling is destined to influence the Florida foreclosure homes and real estate market. The Court’s bank-friendly ruling on Bartram v. US Bank National Association has made many lenders happy while creating a new sense of uncertainty for homeowners.  The ruling allows lenders to simply circumvent the statute of limitations rules set by the State and refile on some dismissed cases from years back.  In the past, the banks had 5 years to foreclose on homeowners who defaulted on their mortgages but the new ruling is giving another lifeline to the lenders to refile the foreclosure process on the delinquent homeowners.  This is regardless of the possibility that the cases began over five years ago, passing the statute of limitations.

Although, it is difficult to predict the exact effects of this ruling on the number of the new Florida foreclosure homes, but experts believe the outcome could introduce noticeable new cases to the courts.  The spokesman for the Florida Supreme Court has pointed to the possibility of only a minimal increase in the number of the foreclosure filings, while the real estate experts think otherwise.  Most real estate attorneys and other professionals think the Bartram ruling will eventually result in a massive increase in foreclosed homes through refilling of the old cases by the lenders.

The problem started in aftermath of the 2006 real estate crash, which resulted in the hundreds of thousands of delinquent mortgages.  Banks struggled to process the unexpected workload caused by the widespread number of unpaid loans.  Since lenders weren’t prepared to face such a huge problems, the cases dragged out and some thrown out of courts.  After the 5 years of the statute of limitations expired, the delinquent cases fell into a black hole of uncertainty.  The homeowners occupied their homes, most without making their mortgage payments and banks could not refile the dismissed cases because of the statute of limitations.

Effects of The Supreme Court Ruling on Florida Real Estate Market

In our opinion, since the Florida real estate market facing a constant shortage of inventory, the Florida Supreme Court ruling and its aftermath will not have any negative effects but perhaps it will even help the market.   Most of Florida real estate markets have been facing rising prices and lack of homes for sale, creating a solid sellers’ market.  Adding foreclosed properties will only fuel the market and bring more buyers to the State.  The number of the new inventory is unpredictable at this time pending the lenders’ position on modifying the loans and homeowners ability on repaying the unpaid balance.  So far, the signals from lenders indicate their willingness to negotiate instead of going through the costly and time-consuming foreclosure process.  But, it is very difficult to predict what the homeowners will do since each has their own financial challenges and cannot be analyzed as a group.  Our understanding is that the lenders, due to the statute of limitations, could only demand the unpaid balance of the last 5 years, which could be beneficial for homeowners whose foreclosure cases were dismissed prior to 2011.  The question remains if those homeowners will be able to pay the delinquent amount even if a big chunk is dismissed.

The owner’s policy protects the homeowner against title defects and lender policy protects the mortgage holders’ investment on that property.  Although the financial institutions are the beneficiaries of the lenders’ insurance, the home buyers pay the premium.

Title Insurance is one of the lender’s required documents, which is not mandatory in cash sales of properties.  However, it is wise to have title insurance on these types of transactions because the concept of because the properties have changed many hands should not have any title issues have been proven wrong.  The cost of the title insurance in comparison to the total price of a home is minimal that it is not worth the risks of not having title insurance.

The role of title insurance is to protect the current owners from hidden issues which may threaten the ownership of a property.  Some of these hidden hazards could include:

  • Clerical Errors
  • Deed issues, such as transfer of the deed through forgery
  • Spousal or unknown heirs claims on the property
  • Unknown liens or fraudulent activities affecting the deed
  • Transfer of deed through an expired or fraudulent power of attorney

There are restrictions and covenants revealed in your Title Binder or Commitment Package that you may not have known when you made an offer on the property. Though you may have read disclosure documents or even a copy of subdivision or condominium covenants, it is possible that some of the rules and regulations and other covenants have been changed since its initial print. The only way you would find out is to read a copy of the documents in the title insurance binder, which will include the latest and most current copy of documents as they were recorded at the courthouse. You may also find some recent filings related to obligations of the homeowner association indicating their financial standing and future plans, which could result in expensive assessments in the future.

There are two sections at the front of the title insurance binder (or commitment) that summarize what’s included and can give you a quick overview to guide you to the most important items first, or those of most concern. These two sections are the “Requirements,” and the “Exceptions.” Requirements are things the title company says must be done or criteria met before their binder is in compliance and title insurance will be issued. Generally, these are pretty cut-and-dried, such as the seller paying off any mortgages or liens against the property, or paying current taxes due, etc.

The “Exceptions” are a fairly standard set of exclusions that the insurer would not cover.  Some of these exclusions may include:

  • Easements or any claim for easements not recorded previously
  • Any disputes regarding the encroachments and boundary lines of the property
  • Mineral or water rights
  • Taxes or special assessments not shown in public records
  • Mechanic’s Lien not recorded at the time the insurance policy was issued

You’re the customer, and it is your money and investment, so don’t be shy about asking questions about the documents, requirements, and exceptions in the title insurance. There are deadlines for objections that could result in default, so don’t hesitate to examine all documents and the attachments thoroughly.
